GUEST SA Good Morning Sir, isang segment ng Good Morning Club ng TV5 noong Lunes ng umaga November 4 ang controversial lawyer na si Atty. Lorna Kapunan. Bago pa matapos ang panayam sa kanya ng mga hosts nitong sina Erwin Tulfo at Martin Andanar, nausisa sa abogado ang tungkol sa visitation rights ng kliyente nitong si James Yap.
Ayon pa kay Erwin, “Mam isa pa pong…last na lang ha? Kumustahin ko lamang sana… may nagsabi ho sa akin, meron ho akong nari-receive na information, mukhang hindi raw sinusunod ni Kris Aquino, ‘yung presidential sister, ‘yung kautusan ng korte pagdating po sa visitation rights. How true is this?”
Tugon ni Atty. Kapunan, “It’s very sad but it’s very true. Ah, although I cannot talk about the case kasi meron kaming gag order, eh gusto ko lang sabihin na, I make this an appeal on air na sana sundin naman niya ‘yung visitation orders because from… napag-agree na ‘yan, eh. Ginawa ngang easy for the son ‘no, for both parties and the son to see the father. Eh, hanggang ngayon hindi pa rin sinusunod.”
Dagdag pang tanong ni Martin, “Meron ba talaga kayong usapan Attorney, kailan dapat puwedeng bumisita si James o kalian puwedeng dalhin si Baby James kay James?”
Sagot nito, “Ah, ‘yun hindi ko puwedeng sabihin for security purposes because the little boy is also a public figure ‘no, ang puwede ko lang sabihin eh, ito ay with the court order, ito ay with the studies of the psychologist. This is also with the recommendation of the social worker. And with the agreement of both parties and the little boy himself. And ah, kapag sinasabi nating rule of law, eh sana naman nobody is above the law.”
Tanong pa ni Erwin, “Nag-file na po ba kayo Mam… charge na contempt o si judge ay hindi ba niya kinu-contempt ito ngayon si Kris for not following her orders or the order of the court?”
Kuwento ni Atty. Kapunan, “We are thinking about it.”
Dagdag pa ni Erwin, “Ah, kayo, magpa-file pa lang kayo? Hindi pa kayo nagsusumbong kay judge na, ‘Judge hindi naman sinusunod itong order namin… itong order ninyo?’”
Paliwanag ni Atty. Lorna, “Kasi ‘pag ganyan ‘yung contempt, separate case ‘yan ‘no. Hindi ‘yan puwedeng i-file by motion. You have to file a separate case. Eh, nag-move on ‘no, we’re very happy that James has moved on ‘no, with regards to his personal love life. And then to involve them again into this tug of war, sana huwag na lang.”
Saad naman ni Erwin, “May mga nagsasabi kasi madam na kaya pumayat daw si James Yap eh, dahil sa hindi niya makita ang anak niya?”
Dugtong naman ng abogada, “That is true ‘no, that is true. In fact, at the height of this fight, this controversy between the mother and father, na si Kris at si James, doon ‘yung sumakit ‘yung back pains niya at saka na-affect ‘yung kanyang performance in the last games ‘no. I would see him naka… ano tawag du’n? Naka-fetal position sa court.”

Ang sabi nito, “Ang sabi ng court is, ‘It is good for a child to have the mother and father but they may be not husband and wife anymore, but the child always needs a mother and father growing up. ‘Yun ang order ng court. So, I think ah… we’re praying that both parties will see it… what is to the best interest of the child and set aside their personal differences.”

Sa statement na ipinadala ng abogado ni Kris na si Atty. Siegfried Fortun sa News5, sinabi nitong ipinag-uutos daw ng korte na susunduin ni James si Bimby sa bahay nito.
“The court order on visitation requires James to fetch Bimby in his residence. Kris has been waiting for James to tell her what time he is fetching their son.”
“She has received no messages from James to this effect. Kris is compliant with all court orders relating to visitation and she has no intention of violating those or depriving James of his right to be with his son.”
