NILINAW NG Supreme Court na ang pagkakabawi ng National Artist Award kina Carlo J. Caparas at sa tatlong iba pa.
Ayon sa ulat ng abs-cbnnews.com, sa tatlumpo’t dalawang pahinang desisyong inilabas ng kataas-taasang hukuman nitong nakaraang linggo, sinabi ng SC na ang pagkaka-kansela sa 2009 National Artist proclamations kina Direk Carlo,
former National Commission on Culture and Arts (NCCA) Cecille Guidote-Alvarez, fashion designer Jose “Pitoy” Moreno at architect Francisco Mañosa ay hindi daw nanganaghulugang hindi na sila maaaring makatanggap pa ng naturang parangal.
Nakasaad sa desisyon na pinamumunuan ni Associate Justice Teresita Leonardo-De Castro, “While the Court invalidates today the proclamation of respondents Guidote-Alvarez, Caparas, Mañosa and Moreno as National Artists, such action should not be taken as a pronouncement on whether they are worthy to be conferred that honor.”
Binigyang-linaw rin ng Supreme Court na idineklara lamang nilang invalid ang proclamation numbers 1826 hanggang 1829, kung saan sakop ang apat na personalidad.
Dagdag pa sa desisyon, “Nothing in this Decision should be read as a disqualification on the part of respondents Guidote-Alvarez, Caparas, Mañosa and Moreno to be considered for the honor of National Artist in the future, subject to compliance with the laws, rules and regulations governing said award.”
Samantala, sinabi naman ng korte na ang mga rekomendasyon ng NCCA at ng Cultural Center of the Philippines (CCP) ‘are not binding on the president’.
Bukod sa proklamasyon sa apat, iginawad din ng dating Presidente Gloria Macapagal Arroyo ang mga naturang parangal kina Lazaro Francisco (posthumous for literature), Manuel Conde (posthumous for film and broadcast) at Federico Aguilar Alcuaz (visual arts, painting, sculpture and mixed media).
Ang kanilang mga proklamasyon ay hindi kasama sa binigyan ng ‘halt order’ ng Supreme Court.
Pero, nakasaad sa desisyon, na hindi raw rito isinama ni Ginang Arroyo ang pangalan ni Dr. Ramon Santos (music) mula sa listahan ng mga inirekomenda sa kanya.
Dagdag pa sa desisyon ng korte, “It was well within the President’s power and discretion to proclaim all, or some or even none of the recommendees of the CCP and the NCCA Boards, without having to justify his or her action. Thus, the exclusion of Santos did not constitute grave abuse of discretion on the part of the former President.”
Matatandaang naging kontrobersiyal ang 2009 proklamasyon kina Caparas at sa tatlo pang national artists ng kuwestiyunin ito ng mga alagad ng sining, kabilang na ang National Artist for Literature na si Virgilio Almario.
